REPORT OF POSTING OF AGENDA: Agenda available for public access at the City Hall exterior bulletin board (west side of Council Chamber) by 9:00 pm on Thursday, October 19, 2023, and posted on the City’s website as required by established policies and procedures.
ACCEPTANCE OF THE AGENDA: The Planning Commission will discuss the order of the agenda, may amend the order, note abstentions, and request Consent Calendar items be removed from the consent calendar for discussion.
PUBLIC COMMENTS: This time has been set aside for members of the public to address the Planning Commission on Consent Calendar and other agenda items; and items of general interest within the subject matter jurisdiction of the Commission. RECOMMENDATION: Approval.
1B. CITY OF PALM SPRINGS REQUESTS A GENERAL PLAN CONFORMITY FINDING FOR VACATION OF A PORTION OF PUBLIC RIGHT-OF-WAY, SHOWN AS LOT D & LOT C, CROSSLEY TRACT, MB 32/44, SECTION 29, TOWNSHIP 4, RANGE 4 EAST. (ENGINEERING FILE R 22-04-2230) (FP)
RECOMMENDATION: Approve the request, finding that vacating a portion of public Right-of-Way (ROW) is consistent with 2007 General Plan per Division 9, Part 3, Section 8313, of the Streets and Highways Code of the State of California and pursuant to Section 65402 of the California Government Code
2. PUBLIC HEARINGS:
2A. AN APPLICATION BY KAIDENCE GROUP, LLC COMPRISED OF A DEVELOPMENT PERMIT, A VARIANCE AND CONDITIONAL USE PERMIT FOR A PROPOSED DRIVE-THROUGH COFFEE SHOP ON A 0.46-ACRE PARCEL LOCATED AT 2466 NORTH PALM CANYON DRIVE, (APN 504-250-031) ZONE: PD 113, GENERAL PLAN: MIXED-USE. (CASES DP-2023-0018, CUP-2023-0020, AR-2023-0083 VAR-2023-0007) (KL)
RECOMMENDATION: Adopt the resolution determining the project to be exempt from CEQA review and approving the project with conditions, and recommend approval of the Major Architectural Application by the Architectural Review Committee.
